Communications Alliance Submission to the OAIC Draft Resources for the Notifiable Data Breaches Scheme
Communications Alliance has made a
submission in response to the OAIC’s public consultation on the four pieces of draft guidance for the Notifiable Data Breaches (NDB) Scheme:
- Entities covered by the NDB scheme
- Notifying individuals about an eligible data breach
- Identifying eligible data breaches
- Australian Information Commissioner’s role in the NDB scheme
In its submission, Communications Alliance commends the OAIC for the timely release of the draft guidance documents which, overall, are well structured, well written and comprehensive.
The submission makes a number of suggestions for further consideration and guidance, for example:
- Further guidance regarding the definition of the term ‘holding of information’ and the consequences of that definition on notification obligations;
- Guidance on the application of the legislation to APP entities vs. entities;
- A request for a review of the guidance material 12 months after the commencement of the Scheme;
- A reduced focus on notification and an increased focus on remedial action and prevention;
- Guidance around situations where entities in the supply chain might have diverging opinions on notification requirements; and
- Clarification around the confidentiality of information provided to the Commissioner.
Comms Essentials – Fraud and Mobile Payments

Background:
This Communications Alliance Comms Essentials seminar will focus on fraud committed using a mobile device and mobile payments more generally.
Given consumers’ increasing preference to use mobile devices for all kinds of everyday activities, it is not surprising that these devices are also being used to commit or attempt to commit fraud, particularly for financial transactions.
Also of interest for our industry is the arrival of the New Payments Platform with the launch targeted for November 2017. The new platform will enable real-time clearing and settlement for simple or complex payment solutions, between two people or between many different parties. It is expected that a large number of financial institutions and other organisations will connect to the platform over time.
Fraud, ID theft and mobile payments, the way they relate to each other and what can be done to minimise the former while facilitating the latter is a topic of priority for the telecommunications industry. An informed debate will assist all stakeholders to move into a more secure mobile payments future.
